GENERAL TERMS AND CONDITIONS OF CONTRACTING AND TICKET SALES

1. Event Details and Organizing Entity

  • Event: "Pole Art Showcase: Prólogo"

  • Date and Time: September 6, 2026, at 8:00 PM

  • Venue: Teatre Poliorama, located at Rambla dels Estudis 115, Barcelona, Spain

  • Latest Admission Time: 8:00 PM

Organizers and Sellers (Natural Persons):

(Hereinafter, jointly and indistinctly referred to as "the Organization")

The Event is governed by Catalan regulations on public spectacles and recreational activities, in particular, Law 11/2009 of July 6, and Decree 112/2010 of August 31 (Regulations on public spectacles and recreational activities of Catalonia), as well as by the Venue's own regulations.

 

2. Acceptance of Terms

Please read these Terms carefully before making any purchase. By purchasing, possessing, using, or intending to use any Ticket for the Event, you fully accept and agree to be bound by these Terms.

Acceptance is formalized by checking the box provided for this purpose during the purchase process (non-pre-checked box). If you do not agree with any of these Terms, you must not purchase or use the Ticket.

 

3. Definitions

For the purposes of these Terms, the following definitions apply:

  • Attendee: The person accessing the Event as the holder or bearer of a valid Ticket.

  • Authorized Sales Channel: Exclusively the website www.poleartshowcase.com, the sole medium through which the Organization markets the Tickets.

  • Terms: These General Terms and Conditions of Contracting and Ticket Sales.

  • Ticket: The digital document (PDF and/or QR code) sent by email to the buyer after payment confirmation, which entitles one (1) person to access the Event.

  • Organization: The two natural persons identified in Section 1.

  • Venue: Teatre Poliorama, located at Rambla dels Estudis, 115.

  • User: Any person who accesses the website, regardless of whether they purchase a Ticket or not.

 

4. Authorized Sales Channels

Tickets for the Event may only be purchased through the Authorized Sales Channel specified in Section 3.

The Organization is not responsible for Tickets acquired through any other medium or channel (resale platforms, social media, individuals, or third parties). Such Tickets may not be valid for access to the Event, and the Organization may deny entry to the holder without any right to a refund.

 

5. Purchase Process and Formalization of the Contract

The online purchase process involves the following steps:

  1. The User selects the number of available Tickets on the website.

  2. The User enters the required personal data (first name, last name, and email address).

  3. Before confirming payment, the User can review the order and data entered, identify and correct errors, and view the itemized final price, in compliance with Art. 27 of Law 34/2002 (LSSI-CE).

  4. The User checks the acceptance box for these Terms and the Privacy Policy (non-pre-checked boxes) and completes the payment through the secure payment gateway.

  5. Following payment confirmation, the User receives the Ticket in PDF or QR format via email, along with a confirmation email that serves as an acknowledgment of receipt in accordance with Art. 28 LSSI-CE.

The contract is considered finalized at the moment of payment confirmation and the sending of the Ticket to the provided email address. The User is responsible for providing a correct email address and checking their spam or junk folder. If the Ticket is not received, the User must contact the Organization at info@poleartshowcase.com providing proof of payment.

 

6. Price and Payment Methods

  • Prices are indicated in Euros (€) and include applicable taxes.

  • The final price, with all concepts itemized (including, if applicable, booking or management fees, which will be informed prior to purchase), is displayed before payment confirmation. No uncommunicated charges will be applied.

  • The Organization reserves the right to modify prices for future purchases; the applicable price will be the one in effect at the time the transaction is completed.

  • Payment is made via [credit/debit card / Bizum / PayPal] through the payment gateway [NAME OF THE GATEWAY], which operates under SSL/TLS security protocols. The purchase is only considered finalized once payment has been successfully received.

 

7. Tickets: Validity, Access, and Conduct at the Venue

7.1. Ticket Validity

Each Ticket is personal and entitles only one person to access the Venue. It must be presented in digital format (on a mobile device screen) or printed, with the QR or barcode visible and legible.

The Organization applies technical procedures to detect duplicate, photocopied, manipulated, or counterfeit Tickets. Detection of any anomaly will entitle the Organization to deny access without a refund and, if applicable, take appropriate legal action.

Any Ticket sold, transferred, or used in violation of these Terms may be voided, resulting in the Attendee being denied access without a refund or compensation.

7.2. Access to the Venue and Right of Admission

In application of Law 11/2009 and Decree 112/2010, the Organization exercises the right of admission in accordance with specific admission conditions that are objective, non-discriminatory, and visibly posted at the Venue access points, at the point of sale, and on the website prior to purchase.

Pursuant to the aforementioned regulations, the right of admission shall under no circumstances involve discrimination based on birth, race, sex, religion, opinion, disability, sexual orientation, gender identity, or any other personal or social condition or circumstance, regarding either access, stay, or use of services.

Admission and stay at the Venue are conditional upon:

  • Presenting a valid, complete, and legible Ticket.

  • Providing proof, if requested, of the minimum age required (see Section 7.6).

  • Not introducing dangerous objects, objects prohibited by current regulations, or objects unauthorized by the Venue.

  • Refraining from aggressive, violent, discriminatory behavior, or conduct that incites hatred, causes disturbances, or endangers the safety of the public, artists, or staff.

  • Not possessing or consuming illegal substances.

  • Complying at all times with the instructions of the Organization and Venue staff.

Denial of access or expulsion from the Venue due to non-compliance with these conditions will not entitle the Attendee to a refund or compensation.

7.3. Security Checks

Access may be subject to reasonable and proportionate security checks and searches carried out by access control and Venue security staff in accordance with Catalan regulations on public spectacles. Refusal to submit to a lawful check may result in denial of access without a right to a refund.

7.4. Capturing and Recording

The capturing, fixing, or recording of images or sounds of the Event for commercial purposes or using unauthorized professional equipment is prohibited without written authorization from the Organization. Non-compliance may lead to expulsion from the Venue without a right to a refund.

7.5. Prohibition of Promotional Use

Possession of a Ticket does not grant the buyer or third parties the right to use it, or its content, for advertising, marketing, or promotional purposes (including contests, giveaways, raffles, or bundled sales with other goods or services), unless expressly authorized in writing by the Organization.

7.6. Minimum Age and Minors

The minimum access age and conditions for minors' attendance comply with Law 11/2009, Decree 112/2010, and the specific regulations of the Venue. The Organization may require proof of age via an official document and deny access to anyone who fails to meet the requirements. In extraordinary shows without specific regulations, the competent authority may prohibit the attendance of minors.

7.7. Capacity and Re-entry

The Venue has a limited capacity controlled by its staff. Once capacity is reached, access may be restricted. The temporary inability to access due to full capacity does not, on its own, generate a right to a refund. Re-entry conditions, if any, will comply with Venue policies.

 

8. Resale

The resale of Tickets for profit through any platform, social network, or medium is expressly prohibited. Free-of-charge transfer between individuals is permitted, provided the bearer accepts these Terms. In the event of speculative resale, the Organization reserves the right to cancel the affected Tickets without a refund and to pursue appropriate legal action.

 

9. Cancellation, Postponement, and Refunds

9.1. Right of Withdrawal

In accordance with Art. 103.l) of Royal Legislative Decree 1/2007 (TRLGDCU), the right of withdrawal is not applicable to this contract, as it concerns the provision of services related to leisure activities for a specific execution date or period. Once the purchase is made, changes or refunds are not permitted, except in the circumstances outlined below.

This information is communicated clearly and prominently immediately before the completion of the purchase process.

9.2. Total Cancellation of the Event by the Organization

In the event of total cancellation of the Event due to causes attributable to the Organization, buyers will be entitled to a full refund of the amount paid within a maximum period of 14 calendar days from the communication of the cancellation, using the same payment method. The Organization will outline the refund request procedure.

9.3. Postponement or Date Change

In the event of postponement, purchased Tickets will be valid for the new date. If the buyer is unable to attend the new date, they will have a period of 15 calendar days from the communication of the change to request a refund by writing to info@poleartshowcase.com.

9.4. Non-Essential Changes to the Program

Changes in schedule, program, or non-essential elements of the show (e.g., substitution of supporting artists or variations in duration) that do not alter the essence of the Event do not entitle the buyer to a refund, unless otherwise provided by law.

9.5. Partial Suspension and Force Majeure

If the Event begins and is subsequently suspended, or cannot be completed, due to accidental causes, force majeure (natural disasters, pandemics, administrative prohibitions, etc.), or safety reasons beyond the Organization's control, no refund will be issued, to the extent permitted by applicable regulations. Each situation will be assessed individually in accordance with the law.

 

10. Image Rights and Recordings

Authorized personnel with audiovisual recording equipment, as well as media outlets, may be present at the Venue. By entering the Event, the Attendee accepts that their image and/or voice may be incidentally captured and broadcast by the Organization or authorized third parties for informative or promotional purposes of the Event, in accordance with applicable regulations and the Privacy Policy.

Attendees who do not wish to appear in recordings where they are featured prominently must notify the Organization in writing prior to entering the Venue at info@poleartshowcase.com.

11. Liability of the Organization

Attendance at the Event is at the Attendee's own risk. The Organization will not be liable, except in cases of willful misconduct, gross negligence, or legal non-compliance, for losses, injuries, or damages (direct or indirect) suffered within the framework of the Event. In particular, the Organization is not responsible for:

  • External technical incidents (failures in third-party payment gateways, User email issues, etc.).

  • Expenses associated with attendance (travel, accommodation, etc.).

  • Damage to or loss of the Attendee's personal items.

  • Non-essential modifications to the program.

The maximum total liability of the Organization shall under no circumstances exceed the amount of the purchased Ticket. This limitation does not affect liabilities that the law declares non-waivable nor the mandatory rights of the consumer.

 

12. Warnings and Recommendations

By purchasing a Ticket and attending the Event, the Attendee acknowledges and accepts that:

  • The performances may include stroboscopic lights, smoke effects, or high-intensity sound effects. Persons with photosensitive epilepsy or other relevant medical conditions should consult a professional before attending.

  • Music volume may be high; hearing protection is recommended.

  • In the event of an emergency, the Attendee must follow instructions from Venue and Organization staff.

 

13. Accessibility and Special Needs

For any questions regarding accessibility or special needs, the Attendee may contact the Organization at info@poleartshowcase.com sufficiently in advance of the Event.

 

14. Attendee Support, Complaints, and Conflict Resolution

For any incident, the User can contact the Organization at info@poleartshowcase.com.

In accordance with Decree 121/2013 and the Consumer Code of Catalonia (Law 22/2010), the Organization has official complaint, claim, and report forms (fulls oficials de queixa, reclamació i denúncia) available to consumers, and visibly displays the poster announcing their availability. These forms can also be provided upon request via the contact email.

The consumer User may turn to public consumer services (OMIC of their municipality, Catalan Consumer Agency) and, if applicable, to the Consumer Arbitration System through the Consumer Arbitration Board of Catalonia (Junta Arbitral de Consum de Catalunya), if the Organization is adhered to or accepts arbitration.

 

15. Legal Reservation

The Organization is entitled to undertake appropriate legal, civil, and criminal measures against any attempt at fraud, fraudulent use of Tickets, or damage caused to the Organization, directly or indirectly.

 

16. Data Protection

The processing of the User's personal data is governed by the Privacy Policy, available at [link]. The data provided during the purchase is processed for managing the sale and access to the Event and, if the User expressly consents, to inform them about future events.

 

17. Modification of the Terms

The Organization reserves the right to modify these Terms for legal, technical, or organizational reasons. Changes that substantially affect rights already acquired by the buyer will be notified via email to Ticket purchasers.

 

18. Applicable Legislation and Jurisdiction

These Terms are governed by Spanish law and, where applicable, by regional sector regulations applicable to the location where the event is held. For the resolution of any conflict, the parties submit to the competent Courts and Tribunals, without prejudice to the consumer's jurisdiction; any submission to consumer arbitration shall be understood as referring to the Consumer Arbitration Board of Catalonia.
